These terms are an agreement between you and ARTWRK Studio ("ARTWRK", "we") about using the ARTWRK apps and website. By creating an account you agree to them.

Who can use ARTWRK

ARTWRK is available in the United States. You must be at least 18 years old to create an account. Brand and studio accounts are reviewed and approved by ARTWRK before they can post briefs.

Creator accounts are invite-only. Invite codes are single-use and may not be sold.

Your account

Keep your sign-in details secure and tell us right away if you think someone else has accessed your account. You are responsible for activity on your account, including activity by team members you add to a brand workspace.

How the marketplace works

ARTWRK connects clients, brands and creators. Creators are independent sellers, not ARTWRK employees. Contracts for services are between the client and the creator; ARTWRK provides the platform, payment handling, document signing and dispute review.

Payments and fees

• All payments between clients and creators must go through ARTWRK.
• Milestone payments are held by our payment partner until the client approves the delivery, or until 7 days after delivery if the client does not respond.
• Clients pay the listed price plus applicable sales tax. Optional brief upgrades are priced when you buy them.
• Creators pay ARTWRK a fee from each sale, shown in dollars before they publish or quote. Card processing costs are paid by ARTWRK.
• Payouts to creators are made through Stripe and require a verified payout account.

ARTWRK Wallet

You can add money to your ARTWRK Wallet and use it to pay on ARTWRK. Wallet funds are held by our payment partner, are not a bank deposit, do not earn interest, and cannot be withdrawn as cash. Unused funds can be refunded to the original payment method on request. Wallet terms need compliance review before launch.

Staying on the platform

Asking for or accepting payment outside ARTWRK, or sharing contact details to avoid fees, is not allowed. We may hide messages, issue warnings or strikes, hold payouts, or close accounts that do this.

Content and intellectual property

Creators keep the rights to their work unless they sign an IP transfer, exclusivity or usage agreement for a specific project. Clients receive the rights described in their order or signed documents. You give ARTWRK a license to display content you post so we can run and promote the marketplace.

Documents signed on ARTWRK

NDAs and other agreements signed through ARTWRK are between the parties who sign them. ARTWRK standard templates are provided as a convenience; custom documents uploaded by brands are the responsibility of the brand.

Disputes between users

If a client and creator cannot agree, either can open a dispute. When opening it, either side can also choose to close the project, which cancels milestones that are not funded yet. ARTWRK reviews the project and may release the held funds, ask for a revision, or refund them in full or in part. Response and review times shown in the app are placeholders.

Rules for creators

• Art you sell or deliver must be made by you. AI-generated art is not allowed. You may use AI tools to help with your workflow, such as organizing references or cleaning up files, but not to generate the art itself.
• Fan art of characters or other IP you do not own may only be made as a commission. It cannot be listed or sold as a product.
• Mark anything with nudity or adult themes as mature (18+).
• Breaking these rules can lead to removal of work, strikes, payout holds or account closure.

Fan art commissions

Clients commissioning fan art must sign a statement of understanding: the work is for personal, non-commercial use, the original rights holder keeps all rights, and the client releases ARTWRK and the creator from claims arising from the client's use of the work.

Mature content

Mature (18+) content is allowed when it is marked as mature. It is blurred until a viewer chooses to see it, either for one piece, for one creator, or everywhere. Content that sexualizes minors is never allowed.

Reviews

Clients and creators can review each other after a project. Reviews are optional. Each review stays hidden until both sides have left one, or until 14 days have passed.

Brand plans

Brand accounts are free with one seat and monthly limits on briefs, invites and new conversations. Paid monthly plans add seats and raise the limits. Plans renew monthly until cancelled.

Suspension and closing accounts

You can close your account at any time from settings, once open projects and payouts are settled. We may suspend or close accounts that break these terms.

Disclaimers and limits of liability

ARTWRK is provided as is. To the extent the law allows, our total liability to you is limited to the fees ARTWRK received from you in the 12 months before the claim.

Changes to these terms

We will tell you about material changes at least 30 days before they take effect, by email or in the app.

Governing law

These terms are governed by the laws of the state ARTWRK Studio is registered in.
